By making a payment for the services provided by Xact Designs (hereinafter referred to as “the Agency”), the client acknowledges and agrees to be bound by the terms and conditions outlined herein. It is the responsibility of the client to thoroughly review and understand these terms and conditions, which are available on the Agency’s website.

The client further acknowledges that, by submitting payment, they are accepting the terms and conditions even if they have not explicitly requested or reviewed the terms and conditions document. Failure to review the terms and conditions does not exempt the client from their obligations outlined in this agreement.

 

Logo Placement and Copyright Notice

As part of the web design services provided by Xact Designs (hereinafter referred to as “the Agency”), a small logo representing Xact Designs shall be prominently displayed in the footer of the website. This logo, along with any accompanying copyright notice or attribution text, must remain visible and unaltered for a minimum period of one (1) year from the date of website delivery.

Any attempt to remove, alter, or conceal the Xact Designs logo and associated copyright notice without prior written consent is strictly prohibited. In the event of non-compliance, Xact Designs, registered under the number 316374800, reserves the right to take legal action, including but not limited to seeking damages, injunctive relief, and any other remedies available under applicable law.

By agreeing to these terms, the client acknowledges that Xact Designs retains the right to use the website as part of its portfolio and marketing materials, even after the expiration of the one-year period.
